On June 4, 2025, The French Competition Authority (“FCA”) launched a public consultation on the topic of self-preferencing in the cloud computing sector.  This follows the recent enactment of Law No. 2024-449 on the security and regulation of the digital space (“SREN Law”).  This consultation reflects growing scrutiny of vertically integrated cloud providers that may favor their own services and software at the expense of competitors.

In a decision dated July 24, 2024,[1] the Paris Court of Appeals granted a stay of execution in relation to a €2,700,000 fine imposed on the Association Nationale des Industries Alimentaires (“ANIA”) by the French Competition Authority (“FCA”) in the Bisphenol A case only considering the manifestly excessive consequences of such sanction in view of ANIA’s financial situation and without examining its merits.

On January 31, 2023, the French Competition Authority (“FCA”) presented an interactive network graph tool on its website that identifies references made in FCA antitrust publications (such as decisions, opinions and interim measures published between 2009 2021) to its other publications. The visualization tool represents these references in the form of a graph interconnecting FCA’s publications with one another.
